Terms of Service
EFFECTIVE 25 JULY 2026
DualCue ("the Service") is operated by Li Wenyu, an individual sole operator ("we", "us"). By creating an account or submitting a file for processing you agree to these terms. If you do not agree, do not use the Service.
1. What the Service does
The Service accepts audio and video you provide — either as an uploaded file or as a link to a publicly accessible page — transcribes the speech it contains, optionally translates that transcript, and returns subtitle files or a video with captions rendered into it.
Transcription and translation are performed by automated models. Output is not guaranteed to be accurate or complete, and is not a substitute for professional human translation where accuracy is legally or commercially critical. You are responsible for reviewing output before relying on it.
2. Your content and your rights to it
You keep all rights to the material you submit. You grant us only the limited licence needed to process it: to store it temporarily, transmit it to the subprocessors listed in our Privacy Policy, and return the result to you.
You must have the right to submit what you submit. By using the Service you confirm that you own the material, hold a licence covering this use, or are otherwise permitted by law to make a transcript or translation of it. You may not use the Service to process material you obtained without authorisation.
3. Acceptable use
You may not use the Service to:
- process material that infringes another party's copyright or other rights;
- process sexually explicit material, or material depicting minors in any sexual context;
- produce subtitles intended to misrepresent what a person said, including for deceptive or defamatory purposes;
- circumvent access controls, paywalls or digital rights management on any source;
- resell or redistribute the Service as your own, or exceed your plan's limits through multiple accounts;
- attempt to disrupt, overload, reverse engineer or gain unauthorised access to the Service.
We may suspend or terminate an account that breaches this section, without refund of the current period where the breach is deliberate.
4. Plans, billing and the merchant of record
Paid plans are billed monthly in advance in US dollars. Processing allowances are per billing period and do not carry over.
Purchases are processed by Creem as the merchant of record. Creem is the seller of record for the transaction, appears on your receipt and card statement, and is responsible for collecting and remitting any applicable sales tax or VAT. Your purchase is additionally subject to Creem's own terms presented at checkout.
You can cancel at any time through the customer portal. Cancellation stops future charges and takes effect at the end of the period you have already paid for; access continues until then.
5. Refunds
If the Service fails to deliver what your plan describes, contact support@dualcue.com within 14 days of the charge and we will refund that billing period in full. Refunds are issued through Creem to the original payment method.
We do not refund a period solely because the automated transcript or translation did not meet a subjective quality expectation; the free plan exists so you can assess output quality before paying.
6. Availability and changes
We aim to keep the Service available but do not promise uninterrupted operation. Processing capacity depends on third-party model providers and may be delayed or briefly unavailable. Features may be added, changed or withdrawn; if a change materially reduces what a paid plan provides, we will give notice by email before it takes effect on your account.
7. Liability
The Service is provided as-is. To the extent permitted by law, our total liability arising from your use of the Service is limited to the amount you paid us in the three months preceding the event giving rise to the claim. We are not liable for indirect or consequential loss, including loss of revenue, or for consequences arising from errors in automated transcription or translation.
8. Termination
You may stop using the Service and delete your account at any time. We may terminate an account for breach of these terms, or discontinue the Service entirely with 30 days' notice, refunding any period paid for but not delivered.
9. Governing law
These terms are governed by the laws of the People's Republic of China, without prejudice to any consumer protection rights you hold in your own country of residence. Terms applying to the payment transaction itself are those of Creem as merchant of record.
